「NEW HORIZON English Course」という英語の教科書に登場するエレン先生があまりにかわいいので、ネット上でもリアルな世界でも大人気で、二次創作が出回っている、というニュースがあります。

教科書を利用するためには、教科書著作権協会(http://www.jactex.jp/profile.html)を通して許諾をもらうことが必要です。塾が小学校の教科書の記述を無断でテキストに使っていたなんていう事件もありました。
教科書は文章、イラスト、写真など他人の著作物の集合です。教科書のイラストを無断でコピーや改変したら著作権侵害です。

東京書籍からはこの件に関して、4月13日に、
「NEW HORIZONのキャラクターについて」

という見解が出されました。
今回の問題は、著作権侵害という問題に加え、別の側面があります。エレン先生が、教科書という教育目的の図書を媒介として世に知られたこと、そして、かわいい女の子のイラストであったことです。
女の子のイラストだから、どんな風に使われるかが問題になります。教科書に登場したかわいい女の子が一人歩きして、教育上好ましくない使われ方をしては困る、というのが今回公式見解まで出た、という異例の措置の背景にあると思われます。
男の先生が大人の本のイラストに登場してもこんな風にはならなかったでしょう。

This case caused problems in another aspect in addition to copyright problems. Ms. Ellen, a teacher, has been known through a textbook for junior high school students.
It is a big problem how an illustration of a female appearing in a textbook will be modified and used. Secondary creation undesirable for education should be avoided, and in this case caused unusual circumstances to arise including the announcement of a publisher's formal opinion.
A male teacher appearing in an ordinary book (not a textbook for students) will not result in such circumstances arising.
