Fin Tech (financial technology)特許は金融関連特許です。ビジネスモデル特許としても金融特許はブームとなりましたが、AI関連技術特許が盛んになるとともに、再びFin Tech特許のブームが再来するでしょう。
これを象徴するかのような事件が起こりました。フリー株式会社(freee 株式会社)が、株式会社マネーフォーワードに対して自動仕訳の特許(フリー(株)の「会計処理装置、会計処理方法及び会計処理プログラム」:第5503795号)を侵害しているとして、東京地裁に侵害訴訟を提起しました(H28(ワ)35763号)。
中堅企業や個人事業主を対象にしたクラウド会計の技術であり、ユーザの取引内容に含まれるキーワードを勘定科目に自動的に仕訳してくれるというものです。
このときキーワードがアルファベット、カナ、漢字、中黒の有無など表記のゆれがある場合は、補正するルールが適用したり(エーエヌエー、エー・エヌ・エーをANAに統一するなど)、複数のキーワードが含まれる場合、品目、取引先の順で優先順位を付けることもクレームに記載されています。明細書に挙がっている例では、「モロゾフ JR大阪三越伊勢丹店」という取引内容です。容易に予想がつくのは、JR大阪三越伊勢丹店のモロゾフで贈答品を買ったという取引です。
品目、取引先(モロゾフ)、ビジネスカテゴリー、グループ名(JR)、商業施設名(三越伊勢丹)の優先順位で仕訳されることとなっており、「モロゾフ」の勘定項目である「接待費」が候補として表示されます。
ビジネスモデル特許ブームの2000年頃はインターネットでビジネスを行うこと自体が新しく、今回のFin Tech特許ブームはクラウド、AI関連技術などさらに新しい技術が関わっています。その点では、ビジネスモデル特許の金融特許とは異なるFin Tech特許の発展が楽しみです。

Hello readers. How familiar are you with Fin Tech patents? Fin Tech, (Financial Technology) patents are financial-related patents. Financial patents have become popular as business model patents and they will undergo a second boom now that AI related technical patents are attracting attention.
Let me give you an example of a case that symbolizes this boom. A company called freee Inc. filed an infringement lawsuit against the company Money Forward Inc. at the Tokyo District Court, insisting that Money Forward violated freee's automatic data classification patent (Title of Invention “Accounting device, accounting method and accounting program"; Japanese Patent No. 5503795; patent right holder: freee Inc.) (Heisei 28(wa) No. 35763).
This patent relates to the technology used in cloud data classification, and it is intended for medium-sized companies or individual proprietors. It automatically classifies keywords from transaction details used in user account names.
In this patent, if keywords are not written in a uniform manner, i.e. if something is off with either the Roman Alphabet, Katakana, Chinese Characters, or if an entry has or doesn't have middle dots, a correction rule is applied. (For example, “エーエヌエー", “エー・エヌ・エー" would be unified into “ANA") The claim also states that in a case where complex keywords are included, the entry list is then prioritized in regards to the client's order of entries. The specifications section lists an example transaction: “Morozoff JR Osaka Mitsukoshi Isetan". From this example a transaction in which a present was bought from the Morozoff located at JR Osaka Mitsukoshi Isetan can be easily understood.
The patent classifies keywords in the following order: item, client (Morozoff), business category, group name (JR) and institution name (Mitsukoshi Isetan). Lastly, the account name “Morozoff" is displayed with the “entertainment expense" nomination.
Around the year 2000 when business model patents were on the rise, business over the Internet was new. Recently however Fin Tech patents are on the rise as they involve cloud computing and AI-related patents.
I am looking forward to watching the development of Fin Tech patents as a distinction from financial patents that are business model patents.
