特許検索ということば自体がパソコンで行う調査を意味します。先行特許や先行出願をパソコンで検索します。しかし以前は特許調査や商標調査といいました。
特許事務所には調査を行う専門の調査員がいました。しかし現在では事務所が調査員を専門に置くというより、独立したサーチャーという職種が登場し、検索テクニックの向上を研究しています。特許検索は事務所では各自担当者が行い、外部のサーチャーからアドバイスを受けるようになりました。
特許調査を手で行っていた時代は、公報を一枚一枚手でめくっていました。特許の仕事というと、公報を手でめくる映像が浮かんだ時代でした。時間がかかるため、それが特許事務所の仕事の大きなウエイトを占めていました。私も弁理士になりたてのころは、特許庁の資料館に通い、まるで図書館の閲覧室で勉強するように、一日かけて調査を行っていました。
ところが特許庁の資料館は特許庁ウエブサイトの「電子図書館」に移り、現在はJ-PlatPat(特許情報プラットフォーム)となりました。
公報の手めくり時代は、特許公報や商標公報にページをめくった跡が大きく付いており、人から話しかけられたり、少しでもよそ見をしただけで先行特許を見落としてしまうので気を付けるよう先輩から注意されたものです。
そのような時代でも文字商標の調査はコンピュータで行うことができたものの、図形商標の調査は手めくり調査が必須でした。ところが今は図形商標であってもJ-PlatPatで検索できます。そして発明者や出願人が自分で検索して相談に来るようになりました。
このように皆が各自で調査を行える時代になると、今度は検索の効率化と精度向上が求められます。だからこそサーチャーの存在が必要です。
AIが人間の仕事を奪うといっても、特許業界ではすでに電子図書館が導入された時点で、調査という大きな仕事が効率化された反面、このような新しいテクニックや職種を生み出しています。

The term patent searches means searches for prior patents or trademarks using a computer, which had been referred to in the past as manual patent or trademark searches.
Patent firms had assigned staff specialized for searches in the past. Nowadays, patent firms do not employ such staff but instead, as a new form of employment, they have registered individual searchers who studied ways to improve search techniques. Each one conducts patent or trademark searches at their patent firms as well as receives advice from external searchers.
Before, manual patent searches had been conducted by hand rather than by computer. It was a time when working at a patent office entailed an image of shifting through pages by hand, which of course took time and occupied most of the working hours in patent firms. When I was a freshman, I used to go to the official JPO library and conduct searches as if I studied in a library all day long.
However, the official library was converted into the digital library on the JPO website which eventually became the modern J-PlatPat. (Japan Platform for Patent Information)
Manual searches left large marks on the materials at the official library and I was often warned by my colleges to carefully pay attention to my searches while doing things like talking to others because one could easily flip by the patent they were looking for while doing such things.
Back then during the manual search age, trademarks with words could be searched by computers while trademarks with pictures had to be searched manually. But now, even trademarks with pictures can be searched on J-PlatPat. Even inventors or applicants come to us for advice when conducting their own searches.
When everyone can search by themselves, efficiency and accuracy of searches are required. Searchers who can attain these things are also required.
Although AI can deprive people from work, new jobs such as patent searches were born in the patent industry when the digital library was introduced, and this improved the efficiency of searches.
