11月9日に弁理士試験の発表があり、255名の合格者が出ました。平成21年〜25年は700人以上の合格者を出していたことを考えると、年間合格者数は半分以下になったといえます。なぜ合格者を減らしているのでしょうか。
志願者数が減っていることも一つの要因と思われます。
弁理士合格者数の変動を契機に日本の特許業界を考えてみます。
AI(Artificial Intelligence)の発達により他の業界でも人間の仕事が奪われ、合理化の波が訪れるといわれています。
しかし特許業界に関しては、AIに関する技術自体の特許を扱う仕事であるため、特許の仕事はますます増加すると私は予想します。では明細書をAIで作成することはできるでしょうか。明細書は発明者の話を聞いて先行技術を調査し、クレームを組み立て、実施例を考えて記載するために、最終的には人間が介在する必要があると考えられます。そして拒絶理由に対する意見書、補正書も明細書のいかなる部分をクレームにアップするかにより、引例との違いを生じさせるため、高度な判断が必要です。これも人間の介在なしには行うことができません。
IoT関連発明、AI関連発明の出願が増加すると予想される今日、これらの出願を扱う弁理士の志願者がもっと増えてほしいと願っています。

On November 9, the JPO announced that 255 candidates passed the Japanese Patent Attorney Examination. Between 2009 and 2013, more than 700 candidates passed annually. This year's successful candidates number less than half of those from 2009 to 2013. Why has the number of successful candidates decreased?
One of the main reasons appears to be a decrease in applicants.
Let's think about the Japanese patent industry based on fluctuations of successful candidates of the Patent Attorney Examination.
It is often said that the development of AI (Artificial Intelligence) will deprive humans of work, and industry rationalization will be accelerated.
However, the patent industry handles patents for AI-related technology, so I expect that patent work will increase more and more. I doubt that specifications can be drafted using artificial intelligence. Specifications are drafted after interviewing inventors, searching for prior art, assembling claims, and describing examples, all of which require human intervention. Arguments and amendments in response to reasons for refusal also require advanced personal judgment, particularly when considering which parts of specifications are introduced in claims in order to distinguish them from cited references.
As patent attorneys continue to handle IoT-related and AI-related inventions, it is my hope that the number of candidates applying to be patent attorneys will increase.
