「いきなりステーキ」((株)ペッパーフードサービス)の特許の話です。この店舗でお客にステーキを提供するシステムについて特許されました(第5,946,491号)。
特許請求の範囲にまで「お客様」「伺う」など敬語が使われている点は、この会社の顧客に対する敬意を感じ、私もこの会社に敬意を感じました。

請求項1は、

1. 「お客様を立食形式のテーブルに案内するステップ」
2. 「お客様からステーキの量を伺うステップ」
3. 「伺ったステーキの量を肉のブロックからカットするステップ」
4. 「カットした肉を焼くステップ」
5. 「焼いた肉をお客様のテーブルまで運ぶステップ」

という5つのステップから構成され、

1. お客様のテーブル番号が記載してある札
2. カットした肉の計量器
3. カットした肉を他のお客様の肉と区別するための印し(以下の図面参照)

を備えています。

この特許出願は当初、請求項1は①〜⑤のみから構成されており、「人為的な取決め」であるとして審査で拒絶されましたが、i)〜ⅲ)を追加することにより特許されました。
客の好む量の肉を焼くというのは、画期的なビジネス手法であり、オーダーメイドのステーキが提供されるというビジネス手法の特許です。ビジネスモデル特許はインターネットやパソコンが関与して自然法則を利用していることになるのですが、このようにリアルな世界でのビジネスモデル特許は珍しいです。
しかしこの特許にはまだ続きがあり、第三者から異議申立がされ取消決定が下されました。続きは次回以降です。

This is a story of the patent for a system of providing steaks to customers at a steak shop “Ikinari Steak" (Pepper Food Service Co., Ltd.) (Patent No. 5,946,491). I want to pay respect to this company which uses honorific expressions for “customer" (okyakusama in Japanese) and “ask" (ukagau in Japanese) even in their patent claims.

Claim 1 consists of 5 steps:

1. guiding a customer to a buffet-style table;
2. asking a customer about the quantity of steak which the customer wants:
3. cutting the desired quantity of stake from a block of meat;
4. grilling the cut meat; and
5. bringing the grilled meat to the customer's table, and

comprises:

1. a label describing a customer's table number,
2. a scale for weighing the cut meat, and
3. a mark for distinguishing the cut meat from other customers' meat (see Fig. 3).

Initially, Claim 1 of this patent application consisted of only steps 1 to 5, and was rejected by an examiner because they are only “human rules"; but it was later patented after adding components i) to iii).
Grilling the quantity of meat desired by customers is an epoch-making business method for providing order-made steaks. Business model methods involving the Internet or PCs are determined as utilizing natural laws, but such real-world business model patents are rare.
A third party filed an opposition against this patent and the decision of its cancellation was rendered, which I will explain in the next blog.
