今日も「いきなりステーキ」((株)ペッパーフードサービス)の特許(第5,946,491号)の話題です。
オーダーメイドのステーキの提供システムが特許されましたが、第三者から異議申立てがされて取消の決定が下されました。
特許庁がこの特許を取り消すべきと判断したのは、この「システム」は、客に「好みの量のステーキを、安価に提供するという飲食店における店舗運営方法、つまり経済活動それ自体に向けられたもの」であるという理由です。
これは、突き詰めていえば、技術を利用していないシステム、つまり人間が決めた方法で人手を介してステーキを提供するシステムであることを意味すると私は考えます。
経済活動を目的とする店舗運営方法であっても、インターネットやパソコンを利用していれば、技術的手段を利用しているとして取り消されなかったでしょう。しかしこのステーキ提供システムは全く技術を利用していないから取消の決定が出たといえます。

婚礼の引き出物を受取人名、受取人者住所などを記載した贈呈リストに基づいて、委託して引き出物を送り届ける贈呈方法の特許(第3,023,658号)も、人為的な取決めであるとして異議申立てを受けて取消になっています。

This is a continuation of the patent story of “Ikinari Steak" (Pepper Food Service Co., Ltd.) (Patent No. 5,946,491).
An order-made steak provision system was patented but the decision of its cancellation was rendered as a result of an opposition filed by a third party.
The JPO judged that this patent shall be cancelled because this “system...is intended for a method of managing a restaurant by providing the quantity of meat desired by customers at inexpensive prices, namely economic activities themselves".
I believe this means, in conclusion, that this system manually provides steak by means of a method decided by humans without using technology.
Even if this is a method of managing shops intended for economic activities, if it had used the Internet or PCs, it could be determined as using technical means and the decision of cancellation would likely not have been rendered. However, this steak provision system does not use technology at all and thus the decision of its cancellation was rendered.

A patent for a method of sending gifts by entrusting the delivery of wedding gifts using a presentation list describing names and addresses of recipients, etc., was also cancelled as a result of an opposition filed by a third party because it was an arrangement provided by humans (Patent No. 3,023,658).
