「エバラ焼き肉のたれ」(エバラ食品工業(株))と歌われるCMのあの有名なメロディが、4月に音の商標として登録されていました。

「音の商標」と「焼き肉」と聞いて思い出したのが、商標審査基準が規定する音の商標の識別性です。
「焼き肉の提供｣という役務(サービス)について、｢『ジュー』という肉が焼ける音｣は、役務(サービス)の提供の際に通常発せられる音であるため、識別性がないと規定されています(特許庁「商標審査基準第3条第1項第3号(https://www.jpo.go.jp/shiryou/kijun/kijun2/syouhyou_kijun.htm)
音の商標の識別性は、歌詞ではなく、発せられる音が役務(サービス)を表すものであるかが問題になります。
商品が通常発する音として挙がっている例は、「炭酸飲料」という商品について、「シュワシュワ」という泡の音です。

「エバラ焼き肉のたれ」の(歌詞ではなく)メロディは、「焼き肉のたれ」という商品の内容を表示しておらず、独自のメロディです。だからもちろん識別性はあり、登録されました。

The famous commercial melody “Ebara Yakiniku-no-Tare" (“Ebara sauce for grilled meat" (Ebara Foods Industry, Inc.) was registered as a sound trademark in April.

The phrases “sound trademark" and “grilled meat" remind me of the distinctiveness of sound trademarks provided by the Examination Guidelines for Trademarks (published by the JPO).
These Guidelines state that in the service of “providing grilled meat...the onomatopoeia for sizzling meat [jū in Japanese]" is produced naturally and thus has no distinctiveness (JPO “Examination Guidelines for Trademarks", Article 3, Paragraph 1, Item 3).

This tells us that the distinctiveness of a sound trademark shall be determined based not on its lyrics but on whether the sounds or melodies represent the service.
The Examination Guidelines for Trademarks list the bubbling onomatopoeia for carbonated drinks [shuwa-shuwa in Japanese] as an example of a sound naturally produced from products.

In this case, the melody (and not lyrics) of “Ebara Yakiniku-no-Tare" is unique and does not simply attempt to represent the contents of the product as “a sauce for grilled meat". This granted it clear distinctiveness and thus it was registered.
