意匠法改正がニュースになっています。
特許庁が通常国会に提出するといわれる改正案には、建物の内装、建築物も意匠登録の対象に入るとの報道がされています。

News has come out that the amendment bill to the Design Law—which, reportedly, will be submitted to an ordinary session of the Diet—includes covering both building interiors and buildings for design registration.

意匠は大量生産される物品の形状、模様などを保護する制度です。現行法では、不動産は意匠の物品には入らず、大量生産される可動式建物であれば例外的に意匠の物品に含まれます。

A design protects the shapes, patterns, and other attributes of mass-produced articles. Under the present law, this excludes real estate but includes movable buildings as an exception.

大量生産されない建物の形状も意匠で保護されるとなると、意匠制度は根幹から変わることになります。

If the shapes of buildings—which are not mass-produced—become covered by the Design Law, the design system will fundamentally change.

インターネットにアップロードされている違法画像を違法と知りながらダウンロードする行為も違法になる、との著作権法の改正も報道されています。知的所有権でカバーされる範囲がますます広がり、権利者にとっては好ましいのですが、一般の利用者は活動が制限されるようになります。

It was also reported that downloading illegal images uploaded on the Internet while being aware that they are illegal images shall breach the Copyright Law.
Thus, the scope of protection under the Intellectual Property Law is increasingly expanding, which is desirable for copyright holders but restricts use for general users.

著作権は文化の発展、意匠は産業の発達を目的としています。あまり権利者の権利が強大になると、逆に文化や産業の発達を阻害するのではないでしょうか。

The Copyright Law aims to develop culture, and the Design Law aims to develop industry. Excessive expansion of copyright holders’ rights will inhibit the development of culture and industry.
