意匠法の改正が本日公布されました。一部の規定以外は、本日から1年以内に施行されます。私は弁理士会意匠委員会に入っているので、最新の情報をお知らせできます。
今回の改正は非常に画期的で産業界に一大変革を及ぼすような大改正です。改正点はいくつかあるので今後シリーズでお伝えします。今日は1つだけお知らせします。
画像(物品に記録されていない画像、物品に表示されない画像)
が意匠登録できる対象になります。
画像は改正以前から意匠登録が可能でしたが、
「物品がその機能を発揮できる状態にするために行われる操作の用に供される画像」という難しい表現で規定された画像に限られていました。

たとえばクリスマスカード作成用ソフトウエアをインストールしたパソコンの画面上で表示される、クリスマスカード作成のための画像は、意匠登録の対象になります。

万歩計機能付きスマートフォンに表示される、歩数計算の機能を開始するための画像であれば、意匠登録を受けられる対象になります。
これらは画像が物品(パソコンやスマホ)と結びついているからです。
しかし改正後は、物品と結びついていない画像(例、道路や壁に投影される画像)も意匠登録の対象になります。
クラウド上から取り出され、ウエブサイトに表示される画像(例、「NAVITIME」の画像)も対象になります。今後はウエブサイトの画像も意匠権で保護され得るので、皆がこぞって意匠出願するようになるでしょう。企業、個人の方々ご注意ください。一大変革が起こります。

The amended Design Law was officially announced today; with the exception of some provisions, the amended law will take effect within one year of today. As a member of the JPAA Design Committee, I can inform you of the latest information.
This amendment is epoch-making and will greatly evolve the Japanese industry. I will inform you of a series of several amended points, one of which I will explain today.
Images that are not recorded or displayed on articles can be registered as designs.
Images have been registrable as designs but limited only to “images provided for operations enacted to bring articles into the state of being able to perform their functions,” which is quite a difficult expression.

For example, images for producing Christmas cards, which are displayed on PC screens that have installed Christmas card software, can be registered as designs.

Likewise, images used to start calculating steps, which are displayed on smartphones with pedometer functionality, can also be registered as designs.
These images are combined with articles (e.g., PCs, smartphones) and can be recognized as designs.
Now, however, after the amendment of the Design Law, images that are not combined with articles (like images projected on roads, walls, etc.) will also be registrable.
Images taken from cloud servers and displayed on websites (e.g., “NAVITIME” images) will also be registrable. Website images may also be covered by design rights in the near future, leading everyone to file for design registration applications. Companies and individuals should keep an eye on this great evolvement.
