意匠は「物品」の形状、模様、色彩、これらの組合せです。平成31年改正以前は、意匠は必ず物品について成立するものであり、物品と切り離すことができませんでした。

例

• 「瓶」という物品の曲がりくねった形状
• 「ビスケット」という物品の斬新な形状
• 「シャツ」という物品の模様
• 「靴下」という物品の模様と色の組合せ

このように、必ず物品に施された形状、模様、色彩であり、形状や模様、色彩が独り歩きしてそれのみで成立することはありませんでした。

物品と結びつかない意匠(内装や外装、画像など)が登場

しかし平成31年改正により、①建物の外装や内装、②壁や人体等に投影される画像も意匠の対象になったため、物品と結びつかない形状、模様、色彩の意匠が登場することになりました。
たとえば喫茶店の内装は、テーブル、椅子、カウンター、天井が全体として特有の雰囲気を醸し出して他店と差別化できます。これを意匠登録することは可能ですが、このとき特に物品というものがありません。テーブルや椅子が斬新な形状をしていれば、テーブルの意匠、椅子の意匠として意匠登録することはできます。これはテーブル、椅子という物品の意匠です。
しかしテーブルや椅子、天井、カウンター、天井などの配置による内装は、物品のない意匠です。

Designs consist of shapes, patterns, colors, or combinations thereof for “articles”. Before the amendment in 2019, designs were necessarily applied to articles and could not be separated from articles.

For example

• the curved shape of a “bottle” article
• the novel shape of a “biscuit” article
• patterns of a “shirt” article
• the combination of patterns and colors of a “sock” article

As I’ve described above, shapes, patterns, and colors were required to apply to articles and could not be established alone without being applied to articles.

Appearance of designs unaffiliated with articles (interiors, appearances, images, etc.)

Under the 2019 amendment, i) the appearances or interiors of buildings and ii) images such as those projected on walls or human bodies can be protected by designs, resulting in the appearance of shapes, patterns, and colors unaffiliated with articles.
For example, unique restaurant interiors create a special atmosphere and can be differentiated from other shops. This can be covered as a design despite “interior” articles not existing. This is different from how novel shapes of tables or chairs can be registered as designs, which are simply designs for said “table” and “chair” articles.
However, interiors consisting of unique placements of tables, chairs, or partitions are now registrable as designs unaffiliated with articles.
