(株)トンボ鉛筆の「MONO」消しゴムのパロディーである「ONO」消しゴム(兵庫県小野市)の販売を中止した事件が昨年ありました。

トンボ鉛筆のMONO消しゴムは著名であり、しかも色彩の組合せの商標登録を既に受けています(5,930,334号)。
ONO消しゴムは薄青、白、黒の3段ストライプであり(他の色を組合せたバージョンもある)、特に薄青、白、黒の組合せバージョンが商標権侵害の問題を生じさせました。
しかしこのたび、この争いは決着しました。ONO消しゴムの一方の面はMONO消しゴムと同じデザインであり、他方の面は「Ono」の文字+小野市の風景が印刷されています。

商標の世界ではパロディーは一般に好ましくありません。「商標をもじられる」ことを商標権者は嫌うからです。しかし、まったく同じ商標を許諾を得て他者が使うことは、もちろん認められます。商標法には使用権という制度もあるからです。品質さえ保証されれば、同じ商標を他者が使うことは認めてもよいと考える人が多いです。
今回も「MONO消しゴム」と同じ商標を片面に使うことで解決をみたという事実は、良質な商品に正当な団体が同じ商標を使うことについては、商標権者は異存がないことを表しています。

Tombow Pencil’s MONO eraser is famous in Japan, and a trademark has already been registered for its color combination (no. 5,930,334).
The ONO eraser has three stripes in light blue, white, and black (with variations in other color combinations), and it was the light blue, white and black version in particular that caused issues with trademark right infringement.
On this occasion, however, the dispute has been settled. The new ONO eraser has the same design as the MONO eraser on one side, with the text “Ono” and scenery from Ono City printed on the other.

Within the trademark industry, parodies and imitations are usually not welcome, as trademark right holders dislike ‘trademark parodies’. However, other parties are permitted to use the exact same trademark after obtaining authorization for said trademark, as the Trademark Act has a licensing system. Many people consider it acceptable to allow other persons to use the same trademark, provided that the quality of the products bearing the trademark is guaranteed.
The incident on this occasion—in which a settlement was reached by Ono City using the same trademark as the MONO eraser on one side of their eraser—shows that trademark right holders have no objections against a legitimate entity using the same trademark for a good quality product.
